Terms of Service

Last updated: 31 October 2026

1. Agreement

These Terms govern your use of ShopSmart (the "Service"), operated by HomeIT Business & Consultancy ("we", "us"), a company registered under Thai law. By creating a shop or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If the English and Thai versions differ, the Thai version prevails.

2. What ShopSmart is

ShopSmart is software for running your own online shop: a bilingual storefront at your shop's own web address, a list of your products or services, orders and bookings with numbers and statuses, and confirmation emails to your customers with your payment QR.

ShopSmart is not a marketplace. We do not buy or sell anything, we are not a party to any sale between you and your customers, and we never receive, hold or refund money for anyone. Features may change as the product develops.

3. Who can use it

  • You must be at least 18 years old, or authorised to act for the business you create the shop for.
  • The details you give us, such as your shop name and email address, must be accurate, and you must keep them up to date.
  • We may decline or close a shop where offering the Service would be unlawful.

4. Your shop key

  • When you create a shop, you get a private shop key. It replaces a password for managing your shop and is separate from your public shop address.
  • Anyone with your shop key can manage your shop. Keep it secret, and share it only with people you trust to run the shop.
  • If you think your shop key has leaked, contact us straight away. You can recover your shop link through your registered email address.
  • You are responsible for what is done with your shop key.

5. Your shop and your sales

You are the seller. Every sale or booking is a contract between you and your customer. You are responsible for:

  • your products and services, prices, descriptions, photos and stock, in Thai and in English;
  • delivery, pickup, appointments, returns, refunds and customer service;
  • following the laws that apply to your business, including consumer protection, tax, licences and the rules for regulated goods such as food, medicines and cosmetics.

6. Payments

  • Customers pay you directly with the PromptPay or bank QR you upload. ShopSmart never receives, holds or transfers your customers' money.
  • Check every payment in your own banking app before you deliver. A transfer slip sent by a customer is not proof of payment.
  • An order's "paid" status in the dashboard is set by you or your staff. We do not verify payments for you.
  • Payment and refund disputes are between you and your customer.
  • We take no commission on your sales, on any plan.

7. Your customers' data

When customers order or book, you receive their personal data, such as their name, email address and phone number. Under Thailand's Personal Data Protection Act (PDPA), you are the controller of that data, and we process it on your behalf to run your shop and send order emails. Use customer data only to handle their orders and bookings, or as they have agreed. We do not sell or share shop or customer data. The ShopSmart Privacy Policy explains how we handle data.

8. Your content

  • The text, photos and QR you upload stay yours. You allow us to store, resize and display them to run your shop.
  • You confirm you have the right to use what you upload, and that it does not infringe anyone else's rights.
  • You may not sell or advertise goods or services that are illegal in Thailand, counterfeit or infringing goods, weapons, drugs, adult content, gambling, or goods that need a licence you do not hold.
  • We may remove content or suspend a shop that breaks this section, or when an authority orders us to.

9. Plans and prices

  • Free: up to 20 products or services, the bilingual storefront, 5 themes and a web address, orders, bookings, confirmation emails with your payment QR, and low-stock alerts. No credit card needed.
  • Pro is coming soon. Its price, billing period and payment method will be shown before you subscribe, and its cancellation terms will be added to these Terms before it opens.
  • We will email you at least 30 days before any price change, and a change applies from your next billing period.
  • If we lower the Free plan's limits, existing products will not be removed without notice.

10. AI insights

AI insights on Pro, such as trending products, sourcing ideas and restock forecasts, come from searches of public information and show their sources. They are suggestions to check, not advice, and they can be wrong or out of date. Check suppliers and prices yourself before you decide.

11. Acceptable use

You agree not to:

  • use the Service for fraud, phishing or to mislead customers;
  • send spam, or use customer data for purposes the customer did not agree to;
  • copy, scrape or reverse engineer the Service, or access it by automated means;
  • use the Service in a way that harms the Service or other users.

12. Availability

We aim to keep your shop online at all times, but we do not guarantee uninterrupted service. The storefront, dashboard or emails can be late or unavailable for a while because of maintenance, outages or third-party providers. Planned maintenance is announced in advance where possible. Keep your own copy of your product list.

13. Intellectual property

ShopSmart, its software, themes and design belong to HomeIT Business & Consultancy. You get a personal, non-transferable licence to use the Service while your shop is active. Your content and data stay yours.

14. Limitation of liability

To the fullest extent Thai law allows, we are not liable for lost sales, disputes between you and your customers, unpaid orders or fake transfer slips, or any indirect or consequential loss arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.

15. Ending the agreement

You can stop using the Service and ask us to close your shop at any time. We may suspend or close a shop for a breach of these Terms, or where continuing would be unlawful. When a shop closes, the storefront goes offline, and you can ask us to delete your shop and customer data, unless the law requires us to keep it.

16. Law and disputes

These Terms are governed by the laws of the Kingdom of Thailand. Disputes fall under the jurisdiction of the competent courts of Thailand.

17. Changes to these Terms

We may update these Terms. We will email you about material changes at least 14 days before they take effect. Using the Service after that date means you accept the new Terms.
